检方指控，去年1月至4月间，27岁的康某在分别担任太阳城赌球网站、金沙赌球网站代理期间，使用代理账号，发展下级代理及参赌会员，并接受投注金额达500余万元。康某涉嫌开设DC罪。1 K. J. t1 G0 L1 U# i

昨天庭审时，对于指控，康某表示认可，称：“我就是好赌，并不是想从中获取利益。”康某说，他在牌友张某的介绍下参与到太阳城赌球网站，代理和会员之间通过网银，每周结算一次。

康某表示，去年3月，张某给了他一个代理账号。代理账户不能投注，只能监管下级会员的资金流向，“下级会员跟张某结算是通过我从中帮忙介绍”，自己也没有从中提成。

去年6月，北京市公安局发现，本市存在一个以境外“太阳城”网站为平台的网络赌球团伙，涉案人员涉及全国21个省份，涉赌金额高达21亿元。随后，警方共查获涉案人员120余人，其中9人被批捕，49人被刑拘。& t3 [1 K( p$ {& g! J* w& r; g! W
5 Q, h- T" l9 ?: K8 Z# A 警方介绍，该网站采取股东、总代理、代理、会员等多层级运营模式，进行赌球活动。涉案人员通过类似传销的形式发展下线代理及会员，会员向上级代理缴纳赌资，并获得账号密码，参与网上赌球，网站及代理人员通过对会员下注赌资提取0.5%-0.8%获利。

另据相关司法解释，开设DC罪，是指为他人Dubo设立、提供场所的行为。在计算机网络上建立Dubo网站，或者为Dubo网站担任代理，接受投注的，以及以接受电话投注的方式进行Dubo，而参与者并不集中在一起的，也属于开设DC。提供DC之后，本人是否参与，是否抽取渔利的，不影响本罪成立。 (来源：新京报) |
