中新浙江网4月8日电 (记者 李飞云 通讯员 纪承伟）一安徽籍男青年在浙江乐清务工，因Dubo欠债便萌生偷东西卖钱还债的想法，他瞄上了一辆停在修理厂前修理的工程车，偷车后将车按重量计算卖给废品收购站，获利三万余元。日前，乐清法院审理该盗窃案，判处该男子有期徒刑四年九个月，并处罚金5000元。

7 \6 K! r+ u5 C 今年26岁的赵某是安徽灵璧县人，平时帮别人开车挣钱谋生。2010年10月，他因Dubo欠了很多钱，某天在乐成镇一偏僻处看到一辆红色工程车停在一修理店前修理，便萌生将该工程车偷来当废铁卖的念头。8 g1 p9 G% w: ?$ {; l% ?
/ z: X' H6 M$ q5 a7 g. ~ 于是，他先找到买车的人----雁荡镇高速公路边一家废品收购站。赵某便上前谈价，并对收购站的老板说自己有五辆工程车，其中的一辆旧了，好几年没有交养路费，准备当废铁卖掉。最终，双方谈妥废铁价格按每吨2450元计算。

赵某考虑自己经常在停车的地方出现，就另找个会开车的人。11月2日早上，他在一个介绍所找到一个湖北籍司机，称自己是搞运输的，替他开车一个月工资3000元，对方同意。

事发晚上10时左右，他在虹桥上了司机开来的工程车，一直到雁荡镇一个加油站停车。第二天等司机走后，一个人把偷来的工程车开到原先谈好价钱的废品收购站，并对收购站老板说车辆行驶证已经丢了。$ J. r9 Z$ m) b4 N A, A: A+ U
3 U0 W8 k `& a* |9 D9 H- C 经过称量，该工程车重量是13吨左右，最终双方按36000元成交。后来收购站老板嫌车子里泥巴很多，要求减价，最后赵某得到31300元。

# {2 o# s" a4 k- C; z 经鉴定，该工程车价值5万元。庭审中，赵某辩解该车已经报废，估价过高。车主说，该车是2008年其以23万元购买的。& I1 |# X# n8 i3 K! Y& B2 k

法院认为，赵某也供述该车较新的，其供述与照片相符，该车不属于报废范围，鉴定的价格合理。赵某秘密窃取他人财物，数额巨大，其行为已构成盗窃罪，遂作出如上判决。 |
