新华报业网讯 昨天下午，在南京市白下区成贤街一超市门前，一辆为超市提供配货的白色依维柯送货车，倒车时意外撞倒路边彩票摊点，在商谈赔偿时，驾车司机竟赌气抢走彩票摊点110元钱即开型彩票，随后驾车走了，后有人将肇事司机所驾车牌记下后报警。由于彩票属于有价证券，律师表示该司机可能涉嫌抢夺罪。' [9 X/ W! V6 \% l7 t3 {
昨天下午3点20分许，在白下区成贤街一超市门前，一辆为超市配送货物的依维柯送货车倒车时，因为街道狭窄人流拥挤，一不留神将一位张姓女士负责的即开型彩票摊点撞倒，桌面上的彩票也被撞翻在地。事故发生后，一些过路市民急忙帮助张女士将被撞倒塌的防雨棚给扶起，随后又帮其将散落马路上的彩票一一捡起，但是仍有一部分彩票散落后被污水打湿。后来，卖彩票的张女士数数，被污损的即开型彩票价值几十元钱，考虑到这些被污损彩票后面可能不好卖，张女士在与肇事司机商谈被撞防雨棚赔偿时，提出希望肇事司机能将这几十元即开型彩票买下，还提醒驾驶员，说不定这些彩票还有可能会中大奖呢。但是肇事司机只愿意赔偿被撞防雨棚的50元，对于张女士提出的由其买下被污损彩票，显得很是不乐意。
' }+ v9 g! c( \! B* {% |+ E 最后，眼见一时无法脱身，最后恼羞成怒的肇事司机竟然伸手从彩票销售点，抓起110元的即开型彩票，转身驾车向珠江路方向开去。张女士面对肇事驾驶员如此举动，忙喊有人抢东西啦！但是考虑到摊点内还有大量彩票，并没有敢追上去，后来有热心路人帮助张女士将逃跑车辆号牌记下，并随后报警。后来，热心市民钱先生和另一路人买下了张女士被污损的彩票，这多少让张女士心里温暖不少。
6 h0 ~; |9 U2 M- O! I/ l 警方透露，彩票属于有价证券，本来肇事司机撞倒彩票摊点的赔偿问题，最多属于民事纠纷，但抢夺别人待售彩票，无论案值多少，也有可能上升为刑事案件，现在就希望肇事司机早日到派出所说明情况。 江苏崔武律师事务所曹律师认为：因福利彩票不记名、不挂失，因而一般认定谁持有彩票谁就享有财产权益。彩票在没有出售前，张女士享有该彩票的所有权；而肇事司机未经张女士允许，就拿起彩票逃掉，一旦警方掌握证据，肇事司机就是涉嫌抢夺罪。 |
