去年12月14日零凌晨，被告人李某在大丰市商业街[color=#000080]天朝福利彩票[/color]站，采取扳门把手入室的手段，窃得张某柜台内的人民币17元及票面价格为5元、10元20元天朝[color=#000080]福利彩票[/color]刮刮乐彩券1301张，票面合计价值人民币1[color=#000080]22[/color]00元，该批1301张彩券的中奖额为7450元，李某正在为自己的“幸运”而洋洋得意时，不料在兑付彩券150元后，JC很快就来了。原来，失窃的[color=#000080]彩票[/color]站已将失窃彩票的号码抄送大丰彩票中心，[color=#000080]福彩[/color]中心向所有经营户发出了被盗彩票编号清单，在李某第二天兑奖时被抓获由此案发。. 《扬子晚报》消息：哑贼孙斌到彩票销售点行窃，偷了384张彩票，他刮了刮彩票算出中奖金额1280元，想想目标太大没敢去兑奖。案发后，这没去兑奖的1280元奖金连同彩票面值2710元一并计算进案值，孙斌“亏大了”，并因涉嫌盗窃罪被南京下关检方提起公诉。彩票点发现失窃后报了警，偷彩票的孙斌和“猫眼儿”在现场留下痕迹很快落网。案发后，办案机关统计，“猫眼儿”和孙斌共偷得彩票384张，彩票面值共2710元，中奖金额达1280元。根据《最高人民法院关于审理盗窃案件具体应用法律若干问题的解释》规定，“凡盗窃不记名、不挂失的有价票证，不论能否即时兑现，均按票面数额和案发时应得的孳息、奖金或者奖品等可得收益一并计算”。尽管他们没有去兑奖，这奖额仍一并计入案值。 |
