7 Q' r+ n: d/ e李纳基，1973年生，广州番禺人，曾担任广州市自来水公司供水部、计划统计部营业中心副主任。从2005年8月到2006年9月，李纳基通过自己负责的智能远程水表项目，以购买设备为名，多次骗取广州市自来水公司开立支票，总金额214万余元。为套现支票，其又虚开发票进行冲账。

庭审中，李纳基称，2005年间，其与同事“阿勇”通过介绍并担保一李姓男子Dubo，后收取庄家“阿雄”高额介绍费。谁知李某输钱潜逃，庄家就向他追讨40万元赌债，威胁不还钱就伤害他家人。, l; o0 l& A2 R! }
为了保命，李纳基编造智能远程水表项目需要购置新设备的谎言，并称已与曾有经济往来的某设备公司协商，骗取公司开立多张支票,随后通过虚假手段将支票兑现。

* Q* Q: x3 }8 q1 o! Y对于指控，李纳基承认骗取214万元项目款，称垫付40万元后，除用于日常消费，其余款项大部分用在了买福利彩票和体育彩票，他希望于中奖后归还挪用的款项。但至今为止，其只退还了3万元贪污款。李纳基认为公诉机关的指控有误，其行为应该定性为挪用公款罪而非贪污罪，并称自己有自首情节，请求法院从轻处罚。# {. _& r' a$ Y
